The Management Board of CNT S.A. (the "Company") informs that today, i.e. on 30.12.2022, the Company received a memorandum of understanding signed by the trustee in bankruptcy of Maxer S.A. in liquidation bankruptcy ("Maxer"), ETP S.A. in restructuring and CNT S.A., under which Maxer will file, by 31.12.2022 with a statement of claim against Przedsiębiorstwo Gospodarki Wodnej Wody Polskie (the "Ordering Party") for payment of PLN 49,745,800 as remuneration for works in the backwater zone as part of the "Construction of the Malczyce barrage" project, which it was ready to perform but, for reasons attributable to the Ordering Party, could not. The aforementioned subject matter of the dispute includes, inter alia, the margin of CNT S.A. in the amount of PLN 22,355,400, which Maxer acknowledged as legitimate and agreed to pay if the dispute is validly won, receive its payment and establish collateral from CNT S.A. as specified in the memorandum. At the same time, Maxer undertook to provide, inter alia, CNT S.A. with collateral for the payment of the aforementioned claim in the form of a declaration of submission to execution by means of a notarial deed on the terms set out therein.
